ORGANIZING COMPANY
The organizer of the draw, SOFTY CREAM FRANQUICIAS SL, (hereinafter "the organizer") with C/ JOSE MARIA DE LARA CARVAJAL PAR 13, 30820 ALCANTARILLA (MURCIA) and CIF: B73708802, plans to hold an exclusive draw for its customers through its Instagram account, in accordance with the provisions set forth in the conditions for participation section.
DURATION OF THE PROMOTION AND DATE OF THE DRAW
The entry period for this giveaway begins on June 16, 2025, upon the launch of the specific post on smöoy's Instagram account, and ends on August 18, 2025. The duration of the giveaway may vary; the organizing company reserves the right to modify the dates of the contest.
A total of 3 drawings will be held throughout the summer.
The first will be held on Monday, June 30, the second on Thursday, July 31, and the last on Monday, August 18.
Winners will be notified later that day via an Instagram post and direct message.
PARTICIPATION REQUIREMENTS
Simply participating in the draw implies acceptance of these Legal Bases.
The participation requirements will be the following:
Those people who are over 18 years old and resident in Spain may participate.
Only those who meet the requirements set out in these Legal Bases may participate.
Personal data – which will be requested if you are the winner – must be true.
Participants may enter this sweepstakes as many times as they like. Each entry must include a story with a photo of their Smurf tub (blue ice cream), mentioning @smooy and using the hashtag #SmurfingWithSmooy.
Only stories that mention @smooy and use the hashtag #SmurfingWithSmooy will be considered.
They will not be able to participate:
Staff of the organizing company or companies that maintain a commercial relationship of agency or provision of services and their immediate family members.
Fraudulent profiles or those that do not have truthful information.
DRAW MECHANICS
The mechanics of the draw consist of:
Post a photo in stories with the Smurf tub visible, mention @smooy and add the hashtag #SmurfingWithSmooy
PRIZE
Each drawing will feature eight winners who will each receive an official Smurfs merchandise pack that will include:
Double movie tickets
Official film products (merchandising)
WINNER
Winners will be selected using a random selection tool such as Easypromos, App-Sweepstakes, Cool Tabs, or Comment Picker.
The winners will be announced on Monday, June 30, Thursday, July 31, and Monday, August 18, in a dedicated post and via direct message to the winners.
Eight winners and 8 alternates will be chosen. If the winners don't meet the requirements or cannot be contacted, the prize will go to the first winner on the alternate list, and so on.
If none of the winners or substitutes can be contacted, the draw will be repeated under the same conditions indicated in these legal bases.
CHANGES
The organizer reserves the right to modify or expand these promotional bases, to the extent that it does not harm or undermine the rights of the participants in the draw.
COLLECTION/DELIVERY OF PRIZES
Winners will be contacted privately to request their personal information, and based on this information, the delivery or collection of the prize will be coordinated with them. Prizes must be picked up at a smöoy location of the winner's choice.
The prize awarded will under no circumstances be transferable or subject to changes, alterations, assignments, compensation or conversion into money.
If we do not receive contact from any of the prize winners after a reasonable period of time, they will lose their right to claim the prize, and the first alternate will be contacted. After this, if the first alternate has not been contacted, the same procedure will be followed for the second alternate. If contact has not been established after this period, the drawing will be repeated among the participants under the same conditions.
IMAGE RIGHTS
All participants authorize the organizer to reproduce, use and disseminate their name, surname and image in any advertising and/or promotional activity that is related to this raffle, all in any medium, without said activities conferring the right to remuneration or benefit. any with the exception of the delivery of the prize won in accordance with these rules.
The transfer includes all rights of reproduction, transformation, distribution and public communication of the recording or images captured, without limitation of time or territory. The personal data collected in this giveaway will be governed by the provisions of the smöoy Privacy Policy (https://smooy.com/politica-de-privacidad/).
SOCIAL MEDIA
The promotion is in no way endorsed, administered, or associated with Instagram, and participants release both platforms from any liability for any damages arising from the promotion.
TAX REGIME
The Prize of this promotion is not subject to withholding of Personal Income Tax in accordance with Royal Decree 439/2007, which approves the Personal Income Tax Regulations. Any other tax obligations that the prize may entail, if applicable, in the winner's taxation, will be the responsibility of the winner, so the organizer is released from any future liability. Consequently, the winner will be responsible for complying with the tax and accounting obligations that the prize entails for personal tax purposes.
APPLICABLE LEGISLATION AND JURISDICTION
These legal bases will be governed in accordance with Spanish law. The Courts and Tribunals of the city of Murcia will be competent to resolve any claim or controversy that may arise in relation to the validity, interpretation or compliance with these bases.
